The Kerala Lok Ayukta has moved to curb the use of banking-related words by unregistered bodies, directing that institutions which are not legally authorised cannot present themselves with the terms “bank”, “banking” or “banker” unless other laws specifically allow it. The order is aimed at preventing organisations from adopting language that could mislead the public into believing they are dealing with regulated financial firms.
The decision reflects a basic concern in financial oversight: names matter because they can shape trust. Banks and other authorised lenders operate under strict supervision, including rules on deposits, governance, customer protection and financial stability. In contrast, unregulated entities using similar branding may create the false impression that they have official approval or the power to carry out banking business.
The Kerala Lok Ayukta itself is an anti-corruption and grievance redress body established under the Kerala Lok Ayukta Act, 1999. Its mandate is to investigate allegations of corruption and maladministration against public servants, a category defined broadly in the Act. The institution has also been the subject of legislative changes, including an amendment passed in 2022 that altered how its decisions are implemented and reviewed.
The broader issue extends beyond Kerala. Indian banking law places restrictions on the use of banking terms by entities that are not properly regulated, and co-operative societies that fall outside the authorised framework are not permitted to imply that they offer banking services. The latest order underlines a wider consumer-protection message: before depositing money or relying on a financial service provider, customers should confirm that the institution is formally authorised.
