India extends deadlines for income tax return filing beyond August 31 for non-audit taxpayers

Taxpayers in India with non-audit income have until December 31, 2026, to file belated returns, while those with audited accounts face later deadlines, amidst guidance on how to navigate the extended timelines.

India’s August 31 income tax return deadline mainly applies to taxpayers with business or professional income who are not required to have their accounts audited, according to Business Today and other Indian financial media. That group can include freelancers, consultants, self-employed professionals and small business owners, although eligibility depends on the nature of the income, the audit requirement and the return form that applies.

Missing the date does not always close the door on filing. LiveMint and The Economic Times report that eligible non-audit taxpayers can still submit a belated return until December 31, 2026, though late fees and interest may apply. Under Section 234F, the penalty can be Rs 5,000 for those with income above Rs 5 lakh and Rs 1,000 for taxpayers below that threshold. A refund claim is still possible if the return is filed and verified within the allowed period.

Those with accounts that must be audited get more time. Business Today says the filing deadline for that category is October 31, 2026, while the tax audit report itself must be filed by September 30, 2026. Taxpayers with specified transfer-pricing obligations under Section 92E have until November 30, 2026. LiveMint likewise notes that these later dates apply to companies, partnership firms and others caught by audit rules or cross-border reporting requirements.

Advisers say taxpayers should not rely only on the form number when working out the deadline. Instead, they should check income sources, audit status and the information in the Annual Information Statement and Form 26AS before filing. Keeping PAN, Aadhaar, bank statements and other records ready can help reduce errors and last-minute problems.
