A missed payment usually prompts reminders and warnings first, while lenders must follow formal procedures before auctioning pledged jewellery, including notice, valuation and surplus repayment rules.
Missing a single gold loan EMI does not, by itself, mean your jewellery will be put up for sale. Lenders typically begin with reminders by phone, SMS or app notifications, then may issue written warnings if the arrears continue. LiveMint says the key issue is not the number of missed instalments alone, but the lender’s overdue policy, the loan contract and the rules that apply to that institution. RBI materials also show that banks and finance companies are expected to follow a transparent recovery process rather than move straight to auction. (rbi.org.in)
The situation becomes more serious if payments remain unpaid for around 90 days. At that point, the account can be treated as a non-performing asset, or NPA, under the lender’s prudential rules, which means formal recovery steps may follow. But NPA status and auction are not the same thing: the gold does not become saleable automatically just because the loan has crossed 90 days in arrears. According to RBI’s published directions and notices, lenders must still follow their stated procedures and give the borrower proper information before selling pledged jewellery. (rbi.org.in)
That protection matters because the Reserve Bank has tightened the framework around loans backed by gold and silver collateral. RBI’s 2025 directions, together with earlier supervisory instructions, emphasise valuation standards, written communication and auction transparency. Industry guidance cited by IIFL says borrowers should receive advance written notice before any auction, while the auction itself should be conducted publicly and at a reserve price linked to market value. Borrowers still have a chance to recover their ornaments before a sale is completed. If the jewellery has not yet been auctioned, the lender should be asked for the full outstanding amount, including principal, interest and any legitimate charges, as well as the deadline for curing the default. If a notice has already arrived, it should be checked carefully for the auction date, the amount due and the mechanism for objecting or settling the account. Keeping receipts, SMS messages, emails and notes of conversations can help if a dispute later arises. (rbi.org.in)
If the pledged gold sells for more than the total dues, the extra money is not meant to stay with the lender. RBI guidance and industry summaries both indicate that any surplus, after deducting the loan balance and lawful charges, should be returned to the borrower. That makes it especially important to get the lender’s calculation in writing before the auction, because the final figures will depend on the reserve price, the sale value, accrued interest and any charges allowed under the contract.
